《民事案件若干规定》首次以司法解释的形式将人民调解协议确定为具有民事合同性质, 人民调解的法律效力得到极大的提升, 这对于人民调解的发展来说是具有里程碑意义的事件。但是根据新形势下人民调解的发展要求, 有必要对人民调解协议书的法律效力作进一步的提升。在赋予人民调解协议书的执行力问题上, 可以借鉴仲裁制度中的规定, 当事人可以凭在人民调解委员会主持下达成的人民调解协议书, 请求法院出具调解书, 而法院调解书与判决书具有同等法律效力, 具有给付内容的法院调解书具有强制执行力英语翻译。也可以直接以法院的审核确认书来赋予人民调解协议强制执行力。
